Terms and Conditions

By booking photography services with TS Visuals, the client acknowledges that they have read, understood, and agreed to the following Terms & Conditions. These terms apply to portrait, pet, real estate, and other photography services provided by TS Visuals unless otherwise agreed to in writing.

A $50 non-refundable deposit is required to reserve a session date and time. A session is not considered booked until the required deposit has been received.

The deposit will be applied toward the total cost of the photography services booked.

Additional services, upgrades, or add-ons selected during booking will be added to the total session price.

Any remaining balance is due before final photographs, videos, or other completed media are delivered.

Final media will not be released until the balance for the session and any additional services has been paid in full.

Additional charges resulting from changes to the originally booked services, including travel, property size, additional pets, additional photography time, location-related expenses, or requested upgrades, must also be paid before final delivery.

Clients may reschedule their session with at least 24 hours' notice.

Cancellations or rescheduling requests made less than 24 hours before the scheduled session may result in forfeiture of the deposit. A new $50 deposit may be required to schedule another session.

Failure to attend a scheduled session without notice will be considered a no-show, and the deposit will be forfeited.

Clients are responsible for arriving on time and prepared for their session.

Late arrival may reduce the amount of available photography time. Sessions may still end at the originally scheduled time to avoid interfering with other appointments.

For real estate photography, the scheduled time begins at the agreed appointment time regardless of whether the property is fully prepared for photography.

For outdoor photography, TS Visuals may recommend or require rescheduling because of severe weather, unsafe conditions, poor conditions for the requested photography, or other circumstances outside reasonable control.

When TS Visuals determines that weather or safety conditions require rescheduling, the client's deposit will transfer to the rescheduled date.

Drone photography and videography are particularly dependent upon weather, visibility, wind, airspace restrictions, location conditions, and applicable aviation regulations. TS Visuals reserves the right to postpone, modify, or discontinue drone operations whenever the photographer determines that operating the aircraft would be unsafe, unlawful, or otherwise inappropriate.

If TS Visuals must cancel or reschedule services because of illness, emergency, equipment failure, or another circumstance beyond reasonable control, the client may reschedule without an additional deposit or receive a refund of payments made for services that cannot be provided.

When applicable, clients may receive proofs for reviewing and selecting photographs for final editing.

Proof images are not final photographs and may not represent the finished quality or appearance of delivered images. Proofs may not be edited, altered, reproduced, downloaded when downloading has not been authorized, or publicly posted without permission from TS Visuals.

Only photographs selected for final delivery are included in the client's purchased photography package unless otherwise stated.

By booking TS Visuals, the client acknowledges that they have reviewed and are comfortable with the photographer's photographic and editing style.

TS Visuals retains creative discretion regarding posing, composition, lighting, cropping, color correction, retouching, image selection, and the overall appearance of the finished work.

TS Visuals determines which photographs meet its professional standards for final delivery. Duplicate images, test shots, missed-focus photographs, closed eyes, unflattering expressions, accidental captures, and photographs that otherwise do not meet those standards may be excluded.

Standard editing does not include extensive digital manipulation, major object removal, body modification, replacement of skies or backgrounds, significant property alterations, or other extensive retouching unless specifically included or agreed upon.

Unless otherwise specified for a particular service, final edited photographs will generally be delivered within 2–3 weeks following the session or, when proofs are provided, following the client's final image selections.

Delivery times are estimates and may vary depending on the size and complexity of the session.

Real estate photography will generally be delivered within 24–48 hours following the scheduled property session unless otherwise communicated.

When a 24-Hour Rush Delivery service is purchased, TS Visuals will make reasonable efforts to deliver the applicable real estate media within 24 hours following completion of the photography session.

Clients are responsible for arriving prepared for their portrait session, including clothing, hair, makeup, props, and other personal items they wish to include.

Parents or legal guardians are responsible for supervising minors throughout the photography session.

TS Visuals cannot guarantee any particular pose, expression, photograph, or number of usable images beyond what is specifically included in the purchased package.

The photographer is not responsible for photographs that cannot reasonably be captured because of lateness, unwillingness to participate, failure to follow reasonable instructions, or other circumstances outside the photographer's control.

The client is responsible for the supervision, behavior, and control of all animals participating in or present during the photography session.

Pets must be appropriately restrained, leashed, or otherwise controlled whenever necessary for the safety of the animal, photographer, client, other individuals, and surrounding property.

The client should inform TS Visuals before the session of any known aggressive behavior, bite history, significant behavioral concerns, or other circumstances that could reasonably affect the safety of the session.

TS Visuals reserves the right to pause or end a photography session if an animal displays aggressive, dangerous, or uncontrollable behavior or if continuing the session would create an unreasonable safety risk.

The client is responsible for injuries or property damage caused by an animal under the client's ownership or control to the extent permitted by applicable law.

Because animal behavior cannot be completely controlled or predicted, TS Visuals does not guarantee specific poses, expressions, interactions, or photographs.

Unless otherwise stated in the selected package, the base pet photography session includes one pet. Additional pets must be included in the booking or approved by TS Visuals before the session and may require an additional fee and/or additional session time.

The client, property owner, listing agent, or other responsible party is responsible for ensuring that the property is clean, staged, accessible, and photo-ready before the scheduled appointment time.

TS Visuals is not responsible for cleaning, staging, landscaping, making beds, organizing rooms, or moving furniture, vehicles, trash containers, personal belongings, or other property.

The photographer may make minor adjustments when reasonable but is not responsible for preparing the property for photography.

Items visible when the property is photographed may appear in the final photographs. Removal of unwanted objects during editing is not included unless specifically agreed upon.

The person booking the service represents that they have the authority or permission necessary for TS Visuals to enter and photograph the property.

The client is responsible for arranging access to the property at the scheduled time, including keys, lockboxes, access codes, agent access, homeowner permission, or other necessary arrangements.

Delays caused by unavailable or inaccessible properties may reduce available photography time and may require rescheduling.

Real estate photography pricing is based in part on the property's size and the services selected at booking.

Clients are responsible for providing reasonably accurate property information when booking and selecting the appropriate square-footage option when required.

If the property's actual size falls within a higher pricing tier than the service purchased, TS Visuals may adjust the final invoice accordingly.

Properties outside the listed size ranges may require a custom quote.

Whenever reasonably possible, occupants should remain out of rooms while they are being photographed.

Pets should be safely secured before the photographer arrives unless their presence has been specifically discussed beforehand.

TS Visuals is not responsible for delays or photographs that cannot be completed because of occupants, unsecured animals, inaccessible rooms, contractors, ongoing cleaning, construction, unsafe conditions, or other circumstances beyond the photographer's reasonable control.

Drone photography or videography is available only when specifically booked and is subject to weather, location, airspace, regulatory, equipment, and safety limitations.

Booking drone services does not guarantee that a drone flight will be possible.

TS Visuals retains sole discretion regarding whether a drone operation can be conducted safely and lawfully. Drone operations may be modified, postponed, or canceled because of weather, wind, temporary flight restrictions, controlled or restricted airspace, nearby hazards, people or vehicles, property conditions, equipment issues, or other operational considerations.

If a drone service cannot safely or legally be performed, TS Visuals may reschedule the drone portion of the service or adjust/refund the amount paid for the affected service as appropriate.

Unless otherwise agreed in writing, TS Visuals retains the copyright to all photographs, videos, and other creative media produced by TS Visuals.

Clients receiving portrait, pet, family, or other personal photography receive permission to use their purchased or delivered photographs for personal purposes, including personal printing and sharing on personal social media accounts.

Personal-use photographs may not be sold, licensed to another person or business, used to advertise products or services, or otherwise used commercially without written permission from TS Visuals.

For paid real estate photography, the client receives a limited license to use the delivered photographs and media to advertise and market the property for which the photography was originally commissioned.

Unless otherwise agreed in writing, this license does not transfer ownership or copyright of the photographs to the client.

Images may be used by the commissioning client or listing agent for the property's MLS listing, real estate websites, social media, digital advertising, printed listing materials, and other reasonable marketing associated with that property.

Photographs may not be sold, sublicensed, transferred, or provided for independent commercial use by another agent, brokerage, builder, architect, interior designer, property management company, publication, vendor, or other third party without permission from TS Visuals.

Any additional commercial licensing may be arranged separately.

Clients are asked not to substantially alter final photographs when sharing or publishing them.

This includes applying filters, significant color changes, AI-generated alterations, excessive retouching, or other modifications that materially change the photographer's finished work.

Normal resizing and cropping required by websites, MLS platforms, or social media platforms is permitted.

The client is responsible for obtaining any necessary permission to photograph at locations selected or requested by the client, including privately owned venues, businesses, residences, or properties.

The client is also responsible for disclosing known restrictions that could reasonably interfere with the requested photography.

TS Visuals is not responsible for services that cannot be completed because required permission, access, or authorization was not obtained by the client.

Booking a photography session does not automatically grant TS Visuals permission to use identifiable photographs of the client for advertising or promotional purposes.

Permission to use identifiable photographs on the TS Visuals website, portfolio, social media, advertising, competitions, publications, or other promotional materials may be requested separately through a model release.

Clients may decline promotional use without affecting the photography services they receive.

For minors, promotional use requires authorization from a parent or legal guardian.

For real estate photography, TS Visuals may request permission to display property photographs in its professional portfolio and marketing materials. When privacy, occupancy, address visibility, security, or other concerns apply, clients are encouraged to notify TS Visuals.

TS Visuals reserves the right to refuse, pause, modify, or discontinue any photography activity that the photographer reasonably believes presents an unsafe condition to the photographer, client, participants, animals, equipment, or property.

The client agrees to disclose known hazards or unsafe conditions at the photography location before services begin whenever reasonably possible.

TS Visuals will take reasonable precautions to protect captured photographs and provide the services agreed upon.

In the unlikely event photographs or other media are lost, corrupted, damaged, or otherwise cannot be delivered because of equipment malfunction, storage failure, accidental loss, or circumstances beyond reasonable control, TS Visuals' financial liability will not exceed the amount paid by the client for the affected photography services.

TS Visuals is not responsible for circumstances outside its reasonable control that prevent particular photographs from being captured, including weather, location restrictions, client or subject behavior, animal behavior, property conditions, inaccessible areas, lighting conditions, or safety concerns.

Nothing in these Terms & Conditions is intended to waive, restrict, or eliminate any right, remedy, or liability that cannot legally be waived under applicable law.

By booking photography services with TS Visuals and accepting these Terms & Conditions, the client confirms that they have read, understood, and agreed to the policies stated above.

The person completing the booking represents that they are at least 18 years old and have the authority to enter into this agreement or to book the photography services on behalf of the applicable client or organization.
